Terms and Conditions
These terms govern your use of the Toyokra website (toyokra.com) and any order you place with us. By using the site or enquiring about a purchase, you agree to these terms. If you do not agree, please do not use the site.
1. About us
Toyokra GmbH is a small workshop based in Lübeck, Germany. We design and make wooden toys and related items by hand, and run evening workshops for adults and families. We operate under German law.
2. Use of this website
You may use this website for personal, non-commercial purposes. You may not copy, redistribute or use any content from this site for commercial purposes without our written consent. We reserve the right to restrict or terminate access in cases of misuse.
The site is provided as-is. We make reasonable efforts to keep information current and accurate, but cannot guarantee that all content is free from errors or omissions at all times.
3. Orders and the purchase process
We do not operate an automated online shop. All orders are handled by direct enquiry — through the contact form on this website, by email, or by phone. A contract is formed when we confirm your order in writing (by email). Until that point, no binding agreement exists.
We reserve the right to decline any order, for example if an item is no longer available or if there is an error in the quoted price.
4. Prices
All prices shown on this website are in euros and include German VAT (19%) where applicable. Shipping costs are not included and will be quoted separately based on your location and the items ordered. For orders within Germany, we typically ship by DHL. For EU destinations we arrange shipping by agreement.
Prices are subject to change without notice, but the price agreed at the time of order confirmation is binding.
5. Custom orders
Custom pieces are made to your specification. A non-refundable deposit of 50% is required before work begins. The deposit covers materials and design time. The balance is due before shipping or collection. Lead times are discussed at the time of ordering — typically four to eight weeks depending on our current workload.
6. Workshops
Workshop bookings are confirmed by email and require full payment in advance. Cancellations made more than seven days before the workshop date receive a full refund. Cancellations within seven days are non-refundable, but you may transfer your place to another person by notifying us in advance. We reserve the right to cancel workshops with fewer than two confirmed participants; in that case, a full refund is issued.
7. Returns and your right of withdrawal (EU consumers)
If you are a consumer in the EU and purchase a ready-made item from us, you have the right to withdraw from the contract within 14 days of receiving the item, without giving any reason (Widerrufsrecht under German law). To exercise this right, contact us at [email protected]. You are responsible for the return shipping cost. We will refund the purchase price within 14 days of receiving the returned item.
The right of withdrawal does not apply to custom-made items produced to your specification, as these cannot be resold to another customer.
8. Liability
Our liability for damages caused by slight negligence is limited to foreseeable, typical damages, except in cases involving injury to life, body or health, or a breach of a fundamental contractual obligation. This limitation does not apply to claims under the German Product Liability Act (Produkthaftungsgesetz).
9. Intellectual property
All text, photographs, drawings, designs and other content on this website are the property of Toyokra GmbH or licensed to us. You may not reproduce, adapt or distribute any of it without prior written permission.
10. Governing law and jurisdiction
These terms are governed by the laws of the Federal Republic of Germany. Disputes arising from the use of this website or from any contract with us shall be subject to the exclusive jurisdiction of the courts in Lübeck, unless mandatory consumer protection rules in your country of residence require otherwise.
The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution before a consumer arbitration board and do not do so voluntarily.
11. Changes to these terms
We may update these terms from time to time. The version published on this page at the time of your order or use of the site applies.
